Terms of Service
Date of publication: [DD-MM-YYYY]
These Terms of Service (the "Terms") govern your use of the Kaldet job platform at kaldet.com (the "Platform"), operated by [Legal entity name], business identifier [Business ID], registered at [registered address] ("Kaldet", "we", "us"). By creating an account, posting a job, applying for a job, joining our waitlist, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
Our Privacy Policy explains how we process your personal data and forms part of your agreement with us.
1. Definitions
- Job Seeker means a User who uses the Platform to find work, create a profile, set up job alerts, or apply for jobs.
- Employer means a User who uses the Platform to post jobs or receive applications.
- User means any person who uses the Platform, including Visitors, Job Seekers, and Employers.
- Content means any information, text, files, links, or other material that a User submits to or through the Platform, including profiles, job listings, and applications.
2. What Kaldet does, and what it does not do
Kaldet provides a platform that connects Job Seekers with Employers in Finland's new and emerging industries. We make it possible for Employers to publish job listings and for Job Seekers to discover and apply for them.
Kaldet is an intermediary. We are not a party to any employment relationship, application, interview, offer, or contract between a Job Seeker and an Employer. We do not act as a recruitment agency, we do not employ Job Seekers, and we are not responsible for hiring decisions.
We do not guarantee that any Job Seeker will find work, that any Employer will find suitable candidates, that any listing is accurate or lawful, or that any User is who they claim to be. Users deal with each other at their own risk, and are responsible for their own checks and decisions.
3. Eligibility and accounts
You must be at least 16 years old, or the minimum age required in your country to consent to the processing of your personal data, to use the Platform. If you use the Platform on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.
You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission. We may refuse, suspend, or close accounts at our discretion, as described in Section 12.
4. Job Seeker terms
When you use the Platform as a Job Seeker, you agree that:
- The information in your profile and applications is accurate, current, and your own to share.
- You will apply only for roles you are genuinely interested in, and you will not misuse the application features.
- When you apply for a job, we pass your application to the Employer who posted it. From that point the Employer handles your data as an independent controller, under their own privacy policy. We are not responsible for what an Employer does with your application.
The Platform is free for Job Seekers. We may add optional paid features in future, and if we do, we will make the terms clear before you use them.
5. Employer terms
When you use the Platform as an Employer, you agree that:
- You will post only genuine job opportunities, and every listing will be accurate, lawful, and not misleading.
- You are solely responsible for your listings, your recruitment process, your communications with Job Seekers, and your compliance with all applicable employment, equality, and data protection laws.
- You will handle the personal data of Job Seekers who apply to your roles lawfully and fairly, as an independent data controller.
- You will not use the Platform or the data you receive through it for any purpose other than recruiting for the role advertised, and you will not sell, share, or repurpose applicant data unlawfully.
- You will not post listings that are discriminatory, that advertise unpaid work presented as employment in breach of the law, that promote a pyramid or similar scheme, or that are used to harvest personal data rather than to fill a real vacancy.
You grant us a non exclusive, worldwide, royalty free licence to host, display, and distribute your listings on and through the Platform for as long as they are live, and to use anonymised or aggregated data about listing performance to operate and improve the service.
6. Paid placements
Kaldet does not currently offer paid placements or upgrades. All job listings are free to post. If we introduce paid features in future, we will make the terms clear before you use them.
7. Acceptable use
You agree not to:
- Post or transmit Content that is unlawful, false, defamatory, discriminatory, harassing, obscene, or infringing.
- Impersonate any person or organisation, or misrepresent your affiliation.
- Upload malware, attempt to gain unauthorised access to the Platform, or interfere with its operation or security.
- Scrape, harvest, or systematically collect data from the Platform, or use bots or automated means, except with our prior written permission.
- Use the Platform to send spam or unsolicited marketing, or for any purpose other than genuine job seeking or recruitment.
We may remove any Content that breaches these Terms, and we may report unlawful activity to the authorities.
8. Intellectual property
The Platform, including its design, text, graphics, logos, and software, is owned by Kaldet or its licensors and is protected by intellectual property laws. We grant you a limited, non exclusive, non transferable right to use the Platform for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Platform without our permission.
You keep ownership of the Content you submit. By submitting Content, you grant us the licence described in Sections 4 and 5, so that we can operate the Platform.
9. Third party services and links
The Platform relies on third party services, including hosting, transactional email, and payment processing, and it may contain links to third party sites, such as Employer websites. We are not responsible for third party services or sites, and your use of them is governed by their own terms.
10. Availability and changes to the Platform
We aim to keep the Platform available and working well, but we do not guarantee that it will be uninterrupted, error free, or secure at all times. We may change, suspend, or withdraw features, in whole or in part, and we will try to give reasonable notice of significant changes where we can.
11. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Platform is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.
Nothing in these Terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited under applicable law. Your mandatory rights as a consumer, where they apply, are not affected by these Terms.
Subject to the paragraph above, we are not liable for indirect or consequential loss, for loss of profit, opportunity, data, or goodwill, or for any loss arising from your dealings with another User. Where we are found liable, our total liability to you for all claims connected with the Platform will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred euros (€100).
12. Suspension and termination
You may stop using the Platform and close your account at any time. We may suspend or close your account, or remove your Content, if you breach these Terms, if we are required to by law, or if we reasonably believe it is necessary to protect the Platform or other Users. Sections that by their nature should survive termination, including those on intellectual property, disclaimers, liability, and governing law, will continue to apply.
13. Data protection
We process personal data in accordance with our Privacy Policy, which explains what data we collect, how we use it, and the rights you have. Employers are responsible for their own handling of the personal data of Job Seekers who apply to their roles, as independent data controllers.
14. Changes to these Terms
We may update these Terms from time to time, for example to reflect new features or changes in the law. When we make significant changes, we will take reasonable steps to let you know. The version at the top of this page shows when it was last updated. Continuing to use the Platform after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of Finland. If you are a consumer, you also keep the protection of any mandatory provisions of the law of the country where you live.
We would like to resolve any dispute with you directly, so please contact us first. If we cannot resolve it, disputes will be subject to the courts of Finland, with the courts of [Helsinki] having jurisdiction, unless mandatory law gives you the right to bring proceedings elsewhere. If you are a consumer in the EU, you may also use the European Commission's online dispute resolution platform, and consumers in Finland may contact the Consumer Disputes Board.
